VEHICLE ACCIDENTS

There is nothing simple about a routine automobile accident. Each case in our office is handled individually, and investigations are made with regards to the specific accident. The investigation includes obtaining police reports, photographs, examining the accident scene and obtaining witness statements. This work is all conducted during the beginning stage of your case.

Each case is prepared carefully as though it will go to trial. We have developed a strong reputation for being a well-prepared and diligent firm. The insurance industry is well aware of our presence and reputation. Our method of thorough preparation has afforded us the ability to settle a high percentage of cases without the necessity of going to trial.

However, sometimes the best result can only occur in the courtroom. The insurance companies will want to hold on to the large settlement monies as long as they can, they use litigation as a tool to delay making payment. Our staff with its experience and abundant resources allows us to fast track cases onto the courts trial calendar – this way our injured clients can receive compensation as soon as possible. We can also assist our clients in filing for no-fault benefits to recover their lost earnings and medical bills, and help our clients in resolving their property damage.

New York State has extremely complicated laws regarding exactly who is allowed to file a lawsuit when an individual is injured in a motor vehicle accident. It is important for these individuals to understand their rights.

Auto Accidents

In a matter of seconds, a car accident can leave you with serious and irreparable injuries. After a car accident, it is important to seek thorough medical treatment and explore your options for seeking compensation for the losses you have suffered. If you have been injured in a car accident, it is important to ensure that your rights are upheld. We are committed to representing injured individuals and their families. We provide experienced representation and assistance to clients located in New York.

The most common causes of car accidents are: Being hit from the rear by another vehicle; Being hit by a car making a left turn without yielding the right-of-way to oncoming traffic; Running red lights or stop signs; Hit and run.

If you have been injured or a loved one injured in a car accident – especially if the injuries are serious or a death is involved – it is imperative that you contact an experienced personal injury lawyer immediately. Do not talk with an insurance company investigator or adjuster before you have had the chance to retain a lawyer. The lawyer will often advise you against giving a statement to the insurance company’s adjuster, as they are trained to trick you into saying things that will come back to haunt you at a later stage of the case.

A few tips: Seek immediate medical attention if you are injured; Do not speak with the insurance company without consulting an attorney; Gather as much information as possible (witnesses, times, dates, locations, photographs, etc.); Don’t delay – call now and speak with a lawyer for free.

BUS & MTA Accidents

The Metropolitan Transportation Authority (MTA) is a public corporation handling public transportation in 12 counties in New York and 2 counties in Connecticut.  At Fattore Law, we have handled many cases involving MTA vehicles and facilities. If you or a loved one have been injured due to negligence by the MTA you will have to follow a unique procedural process in order to recover any compensation for your injuries. Our firm is experienced in this field and we know how to timely process these cases.

Common causes of injuries or death caused by a bus include:

The bus starts moving before you are safely on or off it, causing you to fall to the ground and suffer injuries or even be run over by the back wheels of the bus or a passing vehicle, suffering catastrophic injuries such as breaking your limbs or your back, or causing you to hit your head and suffer traumatic brain injuries, or causing serious internal injuries; The bus makes a sudden violent start, stop, or jerk that causes you to lose your balance and fall to the floor or be thrown from your seat and suffer injuries; The bus gets into an accident with another vehicle when pulling away from a stop when it isn’t safe, causing you and the other passengers to be thrown violently around, or injured by flying glass or other debris.

It is important for individuals injured in a Bus and MTA accident to understand their legal rights regarding their injury.  If you or a loved one has been injured in a Bus or MTA accident, contact our office to discuss your potential case.

Immediate Action May Be Required

Depending on whether your accident involved a commercial bus or a government vehicle (such as many school and city buses), you may have only a short amount of time in which to file a claim. The MTA enjoys a number of unique legal protections. For instance, you must file a Notice of Claim with the MTA within 90 days of your accident. Failure to do so can preclude you from bringing a lawsuit for you or your loved one regardless of the merits of the case. Our law firm understands these sometimes subtle, but very important, distinctions in claims involving the MTA. You can rely on our firm to overcome any procedural obstacles while fighting to recover compensation for the damages you have sustained.

Even if you are not certain whether a bus driver or bus company is legally responsible for your accident and injury, you should protect your interests by consulting an experienced attorney. We are happy to answer your questions, even if it turns out you do not have a case. What is important is that you get the accurate information you need and that your rights are protected. Contact us today to see if you have a case, or to answer any questions you may have about a New York bus injury.

Construction Zone Accidents

Construction zones can be commonplace for an accident. Although traffic is contained and often slower in construction zones, signage and heavy equipment can often block an individual’s view. It can be very difficult for motorists to navigate through construction areas, which can lead to various motor accidents. We represent individuals that have been victims of construction zone accidents, including victims that work in construction zones that have been struck by cars and trucks that have veered into construction zones.

There are two broad types of construction site injuries and death:

Accidents involving the construction workers themselves, and accidents involving bystanders and passers-by.

With respect to injuries caused by the carelessness (“negligence”) of an employee working for the same contractor as the injured employee, the injured employee is usually limited to recovering worker’s compensation benefits. However, if the worker was hurt by the negligence of another contractor’s worker, the injured worker has the right to sue the person who injured him or her and that person’s employer. The reason for trying to find a third party who is legally responsible (“liable”) to the injured person is crucial, because if the injured employee’s injuries or death are deemed to come within the parameters of the worker’s compensation system, his or her damages will usually be significantly less than they would be if the injured worker (or the survivors of a deceased worker) could hold a third party liable.

Motorcycle Accidents

Motorcycle accidents are all too common on America’s roads and highways. According to a recent crash data report by the National Highway Traffic Safety Administration (NHTSA), in 2019 there were 5,014 motorcyclists killed in motor vehicle traffic crashes, and 84,000 motorcyclists were injured.

While there are a number of ways a motorcycle accident can happen, one of the most common causes is negligence - either by the driver of the motorcycle or someone operating another vehicle. Victims who suffer pain or financial losses because of someone else’s negligent actions often are eligible to receive compensation.

Motorcycle injuries are amongst some of the most serious automobile accidents that an individual could be involved in.  Death is much more common in motorcycle accidents due to the inherent risk that accompanies the operation of a motorcycle. They are less visible and provide less security than automobiles. A motorcycle injury can be both emotionally and physically traumatic. Motorcycle laws vary from place to place including rules from lane changes to wearing helmets. Finding a lawyer that is experienced in the laws that surround motorcycles where the accident occurred is extremely important. In order to determine the appropriate amount of compensation, insurance adjustors and juries rely on prescribed formulas. Motorcycle injuries can often be quite serious and therefore expensive to treat. Serious head and spinal injuries are common. So are broken feet, ankles, legs, knees, arms, hands, shoulders, neck, back, and chest. We are prepared to handle your motorcycle accident claim.
